Arena Shop Gone?

Ive started a new game (Evil) On xbox fable tlc, and the shop is gone the man who would be selling is there but he is highlighted in blue instead of green. i can steal everything without him noticing. Whats happened

Well, What time of day is it? That's happened to me before, I wanted some potions before the start of the arena, but he kept running away from me, screaming, highlighted purple. So..Maybe if it's Midnight they don't sell?

If you watch the cutscene at the start it seems to work
