Should the people playing FII be banned?

I think that people who are playing fable II before the game's release should be perma banned from XBL. It's not fair that they can do that and not get punished.

1 they are not hurting anyone
2 its still, no matter how awesome, only a game.

If i had the game early, I would be playing it as well, and so would anyone else!
